USER AGREEMENT
This Agreement (hereinafter, the “Agreement”) is entered into between: Ambos Marcan Ecuador Pronósticos Deportivos, a company domiciled in Ecuador, enabled to develop and operate online sports betting, gaming, and entertainment activities (hereinafter, the “Operator”); which operates through a digital platform hosted on a foreign server and available at www.ambosmarcan.com. These terms and conditions contain all information and rules that the online user accepts when using the digital services offered by the Operator and is thereby obliged to comply with these clauses. If the user disagrees, they must refrain from using our services.
PURPOSE
The purpose of this Agreement is to regulate the legal relationship between the User and the Operator within the framework of the development and operation of online sports betting, gaming, and entertainment activities, as well as user registration processes and the creation of the corresponding user account. This Agreement is accepted by the User at the time of account creation or registration and, therefore, it is legally presumed that the User is aware of each and every one of the terms and conditions herein.
The Operator reserves the right to review and amend these conditions at any time. The User undertakes to periodically review the website to be informed of such changes, without prejudice to notices that may be sent to each User. Changes take effect upon publication on www.ambosmarcan.com.
NATURE
This Agreement is a Contract of Adhesion and is formalized through the express acceptance given by the User at the time of registration or account creation. The User’s express acceptance may be manifested by any legally valid means, and evidence and preservation of such acceptance shall in all cases correspond to the Operator; however, account creation, registration, or use of the digital platform www.ambosmarcan.com also constitute such acceptance.
Creating a gaming account, as well as participating in any gaming activities offered by the Operator, implies express acceptance of the terms of this Agreement, as well as the particular rules of all games offered by the Operator as published on www.ambosmarcan.com.
Acceptance of this Agreement and creation of a gaming account does not grant the User an unconditional or unlimited right to participate in the games offered by the Operator; rather, participation is limited to compliance with this Agreement and conditioned upon the Operator’s discretion regarding the subjective scope of its gaming offer.
EFFECTIVENESS AND TERM
This Agreement enters into force immediately after the User completes the account registration process and accepts Ambos Marcan’s Privacy Policy and Data Use.
The Agreement remains in effect until terminated under the terms set forth in Clause Nine.
USER RIGHTS AND OBLIGATIONS
Only natural persons of legal age, with legal capacity, not prohibited from accessing online entertainment activities, and able to contract and assume obligations—whether due to objective or subjective reasons or the territory in which they are located—may acquire the status of User, accept this Agreement, and be a party to the resulting legal relationship.
Statements made at the time of registration are the responsibility of the declarant.
Transactions carried out with persons who have provided false or inaccurate information shall not be void; no one may benefit from their own negligence or willful misconduct.
USER OBLIGATIONS

Act solely on one’s own behalf and for one’s own account.

Identify oneself to the Operator under the terms established by law, always providing true and accurate information.

Comply with the rules and regulations applicable to users set out on ambosmarcan.com.

Behave with honesty and respect toward other users and the Operator.

Meet the minimum age required under the applicable jurisdiction of the User’s residence. By meeting the minimum age, the User certifies full legal capacity and responsibility for their actions.

Refrain from any fraudulent activity or conduct that entails, facilitates, or permits collusion among users, including significantly reducing betting risk or placing hedging bets (by oneself or via third parties) to meet conditions for releasing amounts allocated to bonuses or promotions offered by the Operator; performing benchmarking; or using confidential or privileged information obtained irregularly or as an employee of other operators, providers, certification entities, or any other companies holding information that could affect games offered by the Operator.

Do not alter the normal course of games; expressly prohibited is participation through robots or other technological devices that provide any advantage, no matter how minimal, over users who do not use such devices.

Do not transfer one’s user registration to third parties or enable unauthorized use of it or the account.

Do not create multiple accounts for the same user or from the same IP address.

The User is responsible for understanding how to declare winnings in their country; the Operator is not responsible for withholdings or taxes arising from the User’s transactions.

Do not disclose account credentials to third parties (deliberately or accidentally) and take all precautions when making transactions. All transactions confirmed with the account holder’s username and password shall be valid and official; the sportsbook shall not be liable for any claim in such case.

Acknowledge that the customer account is not a bank account, is not insured, sponsored, or protected by any financial institution insurance or similar systems, and that any balance will not accrue interest.

The User may not impute liability to the sportsbook beyond the operation of online gaming and may not claim damages for technical, electrical, communication, or internet connection issues.

If the User identifies any act, conduct, or service failure, they are obliged to report it immediately via the online chat to our agents. Response time to any request is relative, as each case requires individual attention.

Refrain from affecting in any way—whether slight or substantial—the name, reputation, commercial image, or prestige of the sportsbook or its operators.

Present photo ID, confirm address, or undergo additional verification procedures (request for selfie, verification call, etc.) to verify identity before granting any withdrawal when requested by the Operator.
Failure to comply with any of the above obligations shall result in cancellation of the User’s activities related to or affected by such breach, without prejudice to the Operator’s right to claim damages caused by the User’s breach, and the Operator may retain funds won by any of the methods mentioned above.
USER RIGHTS

Obtain clear, timely, and truthful information about the rules of the game they wish to join.

Collect prizes that may correspond to them within the time and manner established, in accordance with the specific rules of each game; prize withdrawals may only be made between 08:00 and 22:00.

Use the services of ambosmarcan.com freely, without coercion or threats by the Operator, other players, or any third party.

Know at any time the amount wagered and the current balance of the gaming account.

Receive information about responsible gaming practices.

Verify that their personal data are protected in accordance with applicable Personal Data Protection regulations.

Know at all times the identity of the Operator and, in case of complaints or possible violations and upon request, the identification of staff interacting with users.

Request immediate self-exclusion from ambosmarcan.com from the Operator.

Withdraw funds won through betting and gaming activity held in the user account by submitting a withdrawal request in accordance with our conditions. In the event of account closure, the User may withdraw the full balance.

No commissions are charged directly by the sportsbook on withdrawals from online accounts.
OPERATOR’S OBLIGATIONS, RESPONSIBILITY, AND RIGHTS
OPERATOR OBLIGATIONS

Maintain the gaming contract for a period of three (3) months from cancellation of the user’s registration and adopt all necessary measures to protect user data.

Notify the User in advance of any changes to this Agreement. Continued use of the Operator’s services implies acceptance of the new terms.

Keep detailed analytical records of movements related to the User’s gaming account and bets placed for a period of three (3) months.

Perform periodic checks, as established by the Regulator, regarding proper account use.
-
Record in the account, via debits and credits, all operations, including full identification elements of such operations, particularly those related to bets, winnings, refunds, deposits, reimbursements, or bonuses received.

Pay prizes obtained by users through the procedures and means established on ambosmarcan.com and, in any case, make prize payment available through the same means used by the User to pay for participation, unless such means are deposit-only or an investigation for possible fraud has begun.

Ensure the accuracy and periodic verification of data appearing in its user records.

Not dispose of amounts deposited by the User in the dedicated current account for purposes other than ordinary gaming operations.

Immediately suspend a user’s registration if the User has requested self-exclusion through the mechanism enabled on ambosmarcan.com.

Notify the Regulator of identifying data of users who may pose a risk of collusion, who have fraudulently used credit cards or any other payment method, as well as those who have acted using or abusing confidential or privileged information.
The Operator may provisionally suspend any User who, in its judgment, has engaged in abusive, collusive, or fraudulent behavior; used privileged or confidential information of the Operator or third parties; committed identity theft (even if consented); or allowed third-party use of their user registration—until the facts are proven. The Operator may terminate this Agreement if the User has engaged in abuse, fraud, collusion, use of privileged/confidential information, identity theft, or has made their account available to third parties, or otherwise breached obligations herein. Termination shall be unilateral and notified, along with gathered evidence, to the Regulator, canceling all bets and participations affected by the User’s conduct and, where possible, refunding amounts corresponding to the cancellation, without prejudice to compensation for damages caused to the Operator.
The Operator may, in its sole discretion, cancel or suspend the User’s registration at any time and for any reason. Cancellation does not affect the User’s right to reimbursement of the gaming account balance by any means determined by the Operator, deducting expenses and costs that may have been incurred, in addition to any profits obtained fraudulently or unjustifiably. The same applies if the User cancels their account; however, if the User breaches obligations, no refund shall be due.
The Operator reserves the right to limit or deny participation in certain games to users who, in the Operator’s judgment, may harm proper development of gaming activities offered.
The Operator reserves the right to make any changes or add points to the general game rules, as well as to the payment procedures provided therein, without prior written notice. Bets placed before a change will be settled under the prior rules; bets after a change will be settled under the modified rules.
The Operator may, at any time, offset a customer’s debt to the house (including but not limited to changes due to bet settlement under these rules) using a positive balance in the same customer account (including duplicate accounts).
The Operator bears no liability for damages or losses arising from use of this site or its contents. Connection errors or other technical failures shall not be grounds to change or cancel a bet if it has already been registered on the server. The same applies in case of use or misuse of website content by any person, inability to connect to the website, website unavailability, delays in operation or data transmission, failures in data transmission lines, or other errors, whether typographical or related to site maintenance.
The Operator reserves the right to apply withdrawal fees. Such fees depend on the payment method used, currency, and withdrawal amount, and represent an estimate of costs incurred by the Operator to process the withdrawal.
The User agrees to bear costs arising from payment method fees for deposits when they have not wagered 100% of the deposited amount at the time of withdrawal.
Minimum rollover requirement prior to a withdrawal is x1 (one). If the total amount wagered is less than the deposit amount, we reserve the right to cancel all winnings and charge a 10% fee (and 15% if the account balance was funded via card or bank transfer). Minimum fee applicable by region.
Upon requesting a withdrawal, ID verification will be performed. This verification is minimal but not exhaustive; the company may request additional information as necessary to verify a player’s identity. In some cases—depending on the payment method used to fund the account—one or more of the above documents or additional documents not listed may be required.
USER REGISTRATION AND GAMING ACTIVATION
Participation on www.ambosmarcan.com, owned by the Operator, implies that the User has read this Agreement in full and understood and accepted all its terms. The User also declares to be the holder of a user registration linked thereto. Under no circumstance may the User deny knowledge or acceptance of this Agreement and its provisions.
For identification purposes, the User must complete the online form provided at account creation. Opening a user registration requires the User to provide the data referred to above, which the Operator will verify. The user registration may only be activated once the Operator has completed the verification procedure of the data provided and any requested documents.
The User declares that the information provided is true and complete and undertakes to update identifying data promptly using the functions available on the Operator’s website and following any instructions provided by the Operator. The Operator reserves the right to cancel or suspend a User’s registration when false or incorrect data are detected. The User declares and accepts our privacy and personal data processing policies detailed on AmbosMarcan.com.
Once all required information has been entered, the User shall select a unique user identifier (alias or nickname) and a password between 8 and 16 characters, including at least one of the following groups: numbers, lowercase letters, and uppercase letters. The password may not contain: the user’s name or nickname, first or last name, or date of birth. The User is responsible for the use and safeguarding of their username and password; any operation carried out with such credentials shall be valid and effective for all purposes.
Once the Agreement is accepted by the User, the Operator will send confirmation of the user registration opening by email to the address provided by the User, as well as a copy of the Agreement, which will be stored and available in the User’s personal area, including the Privacy Policy.
OPERATIONS IN THE USER REGISTRATION
Activation of the user registration implies the User may make deposits and participate in the products offered by the Operator, as well as withdraw funds from the account, without prejudice to any limitations or prohibitions established for cases where documentary identity verification is required by the Operator.
The User may access the registration only by logging into the Operator’s website using their username and password. The User is responsible for maintaining confidentiality of these credentials and is liable for any acts or operations carried out using them. The User may change the password at any time through the appropriate procedure on the Operator’s website.
The system will block the user registration if the password is entered incorrectly more than three consecutive times or more than five alternate attempts. The system logs all access attempts, including the date and the IP address. If the registration is blocked due to incorrect password use, the User may reactivate the registration by contacting the Operator’s Customer Support and following the provided instructions.
The Operator reserves the right to verify all transactions performed by the User to prevent money laundering and terrorist financing. Transactions deemed suspicious will be reported to the competent authorities.
The account linked to the user registration allows only the following actions:

Deposit funds via any payment methods accepted by the Operator.

Credit the amounts corresponding to game prizes and any refunds made by the Operator.

Withdraw funds credited to the gaming account using any payment means accepted by the Operator. The maximum withdrawable balance shall be the sum of winnings and deposits. Prior to executing a withdrawal order, the Operator may require additional or updated identification, as well as copies of other documents or evidence such as selfies or other means usable for User identification, including facial recognition and biometric means, to verify the User’s identity and/or that they are the holder of the payment method or bank account indicated.
The Operator will suspend user registrations that remain inactive for more than two years without interruption. If a user registration is suspended, no operation may be performed until reactivation and pertinent verifications are completed.
The User may have restricted access to the gaming account during the Operator’s investigation period.
To fulfill its obligations regarding fraud control and User protection, the Operator may request economic and credit information and/or perform economic and credit checks based on data provided by third parties. Likewise, the Operator may request any evidence reasonably necessary to ensure that the user registration and gaming account are used exclusively by the registered holder and to determine ownership of payment methods used for deposits and withdrawals, and, where applicable, to verify authorization for their use.
CLAIMS PERIOD. PRIZE EXPIRY
Users may submit claims to the Operator within three months from the date on which the event giving rise to the claim occurred. After this period, claims will not be accepted.
Prizes expire after three months from the date they should have been settled or credited to the User’s gaming account. This period is interrupted only by a claim submitted to the Operator or, where applicable, by legal action brought before prize expiry.
The Operator will not accept claims referring to expired prizes.
COMMUNICATIONS BETWEEN THE PARTIES
For handling incidents, questions, and claims, the Operator provides a web chat service in addition to the email [email protected] and the ticket system within the User’s personal area.
The Operator may contact the User through any contact means provided by the User in their registration.
The User may communicate through the website’s incident management (ticket) system, which also sends a copy of all communications to the User’s email.
INTELLECTUAL PROPERTY
The Operator grants the User a license to use the Software on a temporary basis, limited to the period during which the User is registered in the Account, non-exclusive and non-transferable, to use the Services. This license is granted exclusively for use via the Internet.
All content of the Account—including, by way of example, texts, photographs, graphics, images, icons, technology, software, links, domains, trademarks, and other audiovisual or sound content, as well as graphic design and source code—are the exclusive property of the Operator or third parties whose rights are recognized by the Operator, and are subject to intellectual and industrial property rights protected by national and international law.
Any use of any of these intellectual or industrial property elements for any purpose, especially commercial, as well as their distribution, public communication, modification, alteration, transformation, or decompilation, is strictly prohibited unless expressly authorized in writing by the rights holder.
Violation of any of these rights may constitute a breach of these provisions and a violation of the User’s obligations.
OBVIOUS AND TECHNICAL ERRORS
The Operator is not responsible for typographical, transfer, or bet accounting errors. In particular, Ambos Marcan reserves the right to correct obvious errors made when entering information (e.g., incorrectly indicated odds, incorrectly indicated teams or events), to declare the corresponding bets invalid, even after the event has ended. In cases of correction of obvious errors, bets are voided and returned. Common examples include:

Odds entry errors: When an odd (or handicap/total adjustment, etc.) is displayed without a decimal separator or with an extra digit. Example: 18 instead of 1.8; 23 instead of 2; 30 instead of 3, etc.

“Mirror errors”: When odds for participants are displayed in a diametrically opposite way (e.g., the favorite— including the live favorite—shows a higher odd than the underdog).

Writing/order errors: All odds are correct, but teams are listed in the wrong order (often for neutral-field events).
Clear indicators of obvious errors include a large discrepancy between Ambos Marcan’s odds and other sportsbooks, or odds that are nearly impossible given the current match situation. The right to determine whether a technical or obvious error occurred belongs exclusively to Ambos Marcan.
Ambos Marcan reserves the right to cancel bets placed with deliberately incorrect odds and obvious errors. The customer will be informed of balance changes immediately.
Ambos Marcan may cancel bets even after the event if such bets were won due to a technical failure or obvious error.
If, for technical reasons, a user’s bets are not provided with the necessary funds in the account, the bets are deemed invalid.
If the customer’s account has been incorrectly credited, Ambos Marcan will notify the customer immediately. If an error creates a negative balance, the sportsbook has the right to cancel unsettled bets even if they were placed before the error occurred.
The company reserves the right to require the User to accept responsibility for any damage caused if the User intentionally exploits a technical or administrative error when making a deposit or receiving money into the account.
BREACHES, SANCTIONS, AND TERMINATION
If we suspect that you have breached any rules of this Agreement, we may refuse to open your account and may suspend or close it. We may also withhold any money in your account (including the deposit) and offset money or damages we have suffered against your account funds, regardless of whether the withheld funds are greater or less than the damages caused.
We also reserve the right to freeze or close your account, or cancel any bets, if we suspect you are involved in illegal or fraudulent activities. Our decision is final.

GROUP/SYNDICATE BETTING AND MATCH/EVENT LIMITS
Users must place bets solely on their own behalf using their own registered gaming account. If recurring bets including the same selections by one or more users are detected, the Operator may consider such bets invalid and cancel them. Even if the official outcome is already known, the Operator reserves the right to void them where, in its judgment, there is sufficient evidence that users have acted in collusion, as a syndicate or organized group, or if suspicious bets are detected within a short period by one or more users.
Bet limits per sporting event are determined based on the user account status and the characteristics of the event or individual bet. If a user tries to place a bet exceeding the established event limits, the system will display a notification on the bet slip stating: “Maximum bet – Limit reached / Official limit exception.” It is prohibited to place parlay/accumulator bets that include the same selection within a single betting event. Breach of this rule or attempts to circumvent system warnings will result in cancellation of all affected bets and, where applicable, refund of the initial stake.
ANTI–MONEY LAUNDERING REPORTS
As a gaming operator, we must comply with the Anti–Money Laundering Law and associated regulations; we will review all transactions and report any suspicious transactions to the corresponding competent authorities.
If you notice any suspicious activity related to any games on the website, you must inform us immediately by sending a message to our WhatsApp chat available to you.
We may block or close your account and withhold funds in accordance with the Anti–Money Laundering Law.
DATA PROCESSING
The processing of your personal data is governed by our Privacy Policy. Acceptance of this Agreement implies acceptance of our Privacy Policy.
DISPUTE RESOLUTION
If the User wishes to submit a complaint or claim regarding the service provided by www.ambosmarcan.com, the client must contact customer service explaining in detail the reasons for such request.
Any request, complaint, or claim the User has regarding the services must be addressed directly to the Service Provider User; the Operator will provide service channels through which the client may submit such requests, complaints, or claims.
Depending on the type of request, the service area may refer the client to a specific department to provide proximity and facilitate a timely response.
In the event of any conflict related to the client’s balance or proper handling of balance movements, the Operator reserves the right to reach an internal compensation agreement with the user at its discretion. This measure may be offered only by the Operator and applies only in specific cases detailed internally and at the company’s discretion.
Claims will not be accepted in cases of difficulties affecting proper system operation caused by failures in the client’s device operation.
The Operator is not responsible for problems or failures in the client’s internet connection affecting platform performance.
Once the user submits a request or complaint, it will be reviewed by the customer service team, which will provide an informational response within the first 24 business hours. If the request relates to an area other than direct customer service, it will be escalated to the appropriate department.
Requests will receive an initial response within 24 to 72 business hours. This timeframe covers the initial response; for final responses or solutions to requests requiring broader processes, the user will be notified of the extension and the status of their case.
JURISDICTION AND COMPETENCE
If disputes cannot be resolved directly, the user waives domicile and agrees to first request a mediation process at one of the authorized Mediation Centers. If the dispute is not resolved, the user waives domicile and agrees to submit to the courts of the city of Manta.
